On July 22nd, 2013 a Polk County jury handed a $1.2 billion verdict down for a nursing home negligence case. After nearly five years, damages were finally handed down. Nursing home negligence is an ever increasing epidemic within the state of Florida.
It took the jury just one hour to come to their decision. $110 million was awarded in damages and $1 billion in punitive damages. Ultimately it’s going to come down to how much of that money will be collected by the plaintiff, Arlene Townsend (family).
She was a resident at the Auburndale Oaks Healthcare Center. When she fell, the argument was that she was not properly supervised. Trans Healthcare was a primary defendant on the lawsuit.
Now in the state of Florida, we’re seeing these verdicts and types of cases frequently increasing year after year. It appears that this Jury has sent a statement with this type of billion dollar verdict. No one will tolerate nursing home abuse or neglect, especially those facilities with poor grades.
